I just went through this several months ago. In Ohio a CDL is not required as long as it is not for commercial use. All surrounding states will honor that law in their state for Ohio residents. Others will tell you the law in their states so you may want to check with your local licensing registrar. That is what I did and that is what I was told. That is also the best way to satisfy yourself.

In VA it has to be less than 26,000# gross weight w/o airbrakes. Above that, you are in CDL territory. Some exemptions apply.

Here is the state of Ohio web site that lists the exemptions from a CDL. About 1/3 of the way down in the first column will tell you what you need to know for your truck and trailer.
